Small Cell Facilities in the Right-of-Way (ROW)
Small Cell Facility Waiver
Pursuant to Section 711.429(d), an applicant may seek a waiver from any requirement, including the objective design standards, by filing a request for waiver with the Department. A request for a waiver shall be filed contemporaneously with the Permit application. The request for waiver shall state each Section, subsection, requirement, standard or criteria for which a waiver is being sought. A request for a waiver shall include a detailed explanation, with supporting engineering or other data, as to why a waiver from the requirements of this Section is required.
Small Cell Facility Administrative Deviation
Pursuant to Section 711.429(d), an applicant may request an administrative deviation from:
- Deviations from the requirement in Section 711.438 prohibiting new poles from being located within two feet of a sidewalk for poles proposed within the Downtown Area, as defined in Section 656.361.2, or in areas with a land use designation of CGC, IL, or IH; and
- Deviations from size limitations regarding pole‑mounted equipment and pole diameter when necessary due to distinct engineering, configurational, or technological requirements associated with the applicant’s Small Wireless Facility or equipment.
