Sidewalk Construction Deferral

A Sidewalk Construction Deferral allows developers and property owners to request a temporary delay on building required sidewalks when construction is currently infeasible or unnecessary. Please note that this deferral application is specifically for residential infill properties. All other types of properties must submit a civil design deviation through JaxEPICS (Applications --> Start Civil Design Deviation Application --> Site Regulations --> Sidewalk construction waiver and payment into sidewalk fund)

Unlike a sidewalk waiver, an approved deferral does not require a payment into the In-Lieu Sidewalk Program. Instead, the applicant must execute and record a legal Agreement for Sidewalk Deferral in the public records of Duval County. This agreement legally binds the current and future owners of the property to construct the sidewalk at their own expense whenever the City of Jacksonville deems it necessary.

Approval is granted on a case-by-case basis at the discretion of the Director of the Public Works Department, based on specific criteria such as surrounding growth, proximity to pedestrian destinations, street layout, and roadway maintenance.
